Terms of Service

1. Request is a technical intermediary

Request operates a creator marketplace and payment coordination layer. Fans may request personalized content from independent creators, and creators may accept, reject, deliver, or manage those requests through the platform.

Request is not a party to the fan/creator agreement except to operate the platform, coordinate payment workflows, handle support and disputes, and enforce Request policies. Request is not the seller, producer, publisher, employer, agent, representative, or guarantor of creator content. The creator, not Request, is responsible for the content they agree to provide and deliver. The fan and creator are responsible for their own transaction and communications, subject to these Terms and Request policies.

2. Eligibility and account duties

You must be legally able to enter a binding contract and must not be barred from using Request, Stripe, or similar payment services. If your jurisdiction requires a higher minimum age for creator monetization, that higher age applies.

You must provide accurate account, identity, payout, tax, and contact information. You are responsible for keeping credentials secure and for activity under your account.

3. Creator responsibilities

Creators act independently. Creators are responsible for evaluating whether they can lawfully and safely accept a request, delivering within the displayed workflow and deadlines, respecting third-party rights, and complying with tax, consumer, advertising, intellectual property, privacy, and platform rules.

Creators must not represent that Request endorses, supervises, produces, approves, or guarantees their content. Request may review accounts, requests, delivery files, payout activity, and related signals to operate the marketplace, reduce fraud, enforce policy, and comply with payment processor requirements.

4. Fan responsibilities

Fans must submit lawful, accurate, non-abusive requests and must not use Request to solicit illegal, harmful, infringing, sexually explicit, exploitative, deceptive, or otherwise prohibited content or services.

Fans acknowledge that personalized creator content can be subjective. A fan does not receive an automatic refund only because they dislike style, tone, timing, performance, or creative choices where the creator substantially delivered what was accepted.

5. Payments, fees, refunds, and chargebacks

Payments are processed through third-party payment infrastructure, including Stripe and Stripe Connect where applicable. Payment availability, verification, holds, reversals, reserves, fees, disputes, and payout timing may depend on processor rules and risk controls.

Request may collect platform fees, processing fees, or other disclosed charges. Request may delay, withhold, reverse, offset, or suspend payouts where required by law, processor rules, suspected fraud, chargeback exposure, policy violations, sanctions screening, account review, incorrect payout data, or unresolved disputes.

Refunds are governed by the Refund Policy. Chargebacks or payment disputes may result in account review, evidence preservation, payout holds, fee recovery, and suspension.

6. Prohibited uses

You may not use Request for illegal activity, adult sexual content, sexual services, exploitation of minors, non-consensual intimate imagery, deepfake abuse, impersonation, harassment, hate, violence, regulated goods or services, gambling, financial services, malware, credential theft, deceptive claims, intellectual property infringement, sale of engagement, or any activity prohibited by Stripe, card networks, law, or Request policies.

AI-generated or AI-assisted content is prohibited when it is deceptive, non-consensual, adult, exploitative, impersonating a real person without authorization, infringing, or otherwise unlawful or unsafe. Users must clearly disclose AI assistance where required by law or platform rules.

7. Moderation and enforcement

Request may refuse, remove, restrict, demote, disable, investigate, preserve, report, or block accounts, requests, creator pages, content, files, payments, or payouts at its discretion where Request believes action is needed to protect users, the platform, payment partners, legal compliance, or marketplace integrity.

Enforcement may include warnings, content removal, request cancellation, refund initiation, payout hold, reserve, account limitation, suspension, termination, reporting to payment processors or authorities, and preservation of evidence.

8. Intellectual property and content license

Users retain ownership of content they submit, subject to rights granted here. You grant Request a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, transmit, display, moderate, analyze, and use submitted content as needed to operate, secure, improve, market, and enforce the platform.

You represent that you have the rights needed for all content you upload, request, sell, deliver, or display. Request may remove content and terminate repeat infringers under its Copyright and DMCA Policy.

9. Privacy, security, and evidence preservation

Personal data is handled under the Privacy Policy. Request may retain transaction, delivery, identity, device, IP, communication, moderation, and payment evidence for legitimate business, legal, safety, tax, fraud-prevention, and dispute defense purposes.

No system is perfectly secure. You must not attempt to bypass access controls, scrape protected data, interfere with the service, or compromise another user account.

10. Disclaimers and limitation of liability

Request is provided "as is" and "as available." Request does not guarantee uninterrupted availability, creator performance, fan satisfaction, legality of user content, marketplace results, or that every harmful use will be detected.

To the maximum extent permitted by law, Request will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost profit, lost revenue, lost data, reputational, or payment processor damages. Request total liability for claims relating to the service is limited to the greater of fees paid to Request by the claimant in the prior twelve months or USD 100, except where law does not allow that limitation.

11. Indemnification

You will defend, indemnify, and hold harmless Request, its affiliates, directors, officers, employees, contractors, processors, and partners from claims, losses, liabilities, damages, costs, and reasonable legal fees arising from your content, requests, delivery, account activity, law or policy violations, payment disputes, taxes, or third-party rights violations.

12. Governing law and disputes

Unless a mandatory consumer protection rule in your country of residence gives you rights that cannot be waived, these Terms and any non-contractual obligations arising from them are governed by the laws of Estonia.

If a dispute cannot be resolved through support, the parties may bring proceedings before the competent courts of Estonia, except where mandatory consumer law allows or requires you to bring a claim in another forum. Nothing in these Terms limits statutory consumer rights, mandatory refund rights, data protection rights, chargeback rights, or rights that cannot legally be waived.

13. Changes

Request may update these Terms. Material changes will be posted through the platform or other reasonable notice. Continued use after the effective date means acceptance of the updated Terms, except where law requires another process.
